Diese Definition legt fest, welche Unternehmen von den Vergünstigungen des IRA profitieren können – und welche nicht. Ein FEOC ist laut der US-Definition jedes ausländische Unternehmen, das "im Besitz einer Regierung einer betroffenen Nation ist, von ihr kontrolliert wird oder deren Gerichtsbarkeit oder Weisung unterliegt". "Betroffen" sind neben China etwa auch Russland, Nordkorea und der Iran.

Unter anderem beim US-Finanzministerium ist nachzulesen: "Um die Sicherheit der amerikanischen Lieferketten zu stärken, darf ein geeignetes sauberes Fahrzeug ab 2024 keine Batteriekomponenten mehr enthalten, die von einem FEOC hergestellt oder zusammengebaut wurden, und ab 2025 darf ein geeignetes sauberes Fahrzeug keine kritischen Mineralien mehr enthalten, die von einem FEOC extrahiert, verarbeitet oder recycelt werden".
Nun hat das Ministerium Leitlinien veröffentlicht. Ab dem nächsten Jahr haben Unternehmen, die zu mehr als 25 % im Besitz oder unter der Kontrolle eines FEOC sind – einschließlich Vorstandssitzen, Stimmrechten oder Eigenkapital – keinen Anspruch auf Steuergutschriften gemäß dem Inflation Reduction Act (IRA). Es soll allerdings eine Übergangsregelung geben, die bereits produzierte Fahrzeuge abdeckt und bis 30 Tage nach der endgültigen Verabschiedung der FEOC-Definition gelten könnte.

Western lithium, graphite miners boost prices for ESG-friendly supply
LOS ANGELES, Nov 17 (Reuters) - Western lithium and graphite miners have started charging the electric vehicle (EV) supply chain higher prices for their material, meeting demand for environmentally-friendly and consistent supply that is not linked to China.
In presentations and interviews at this week's Benchmark critical minerals conference in Los Angeles, industry executives, consultants and investors touted the premium pricing model as a way to help prod development of non-Chinese supply, a goal of Washington, Brussels and other Western governments.

Northern Graphite (NGC.V), which runs a Quebec graphite mine and is building an anode facility, is already selling types of the metal at prices above Chinese rivals, said CEO Hugues Jacquemin.
"Our customers want guarantee of supply, they want quality of material, and they want long-term sustainability," said Jacquemin. "Today, when you buy graphite from China, you don't know where it comes from."

“This news out of China underscores that the onus is on the West to develop secure sources of graphite supply to ensure a smooth energy transition,” said Northern Chief Executive Officer Hugues Jacquemin. “Northern is the only natural graphite producing company in North America, has multiple development projects, and is well positioned to be a real solution for the entire graphite market value chain as demand for this critical component of Lithium-Ion batteries builds in coming years.”
Northern is targeting production expansion at its Lac des Iles mine in Quebec together with the restart of its Okanjande mine in Namibia and construction of its Bissett Creek project in Ontario. A planned 200,000-tonnes-per-year Battery Anode Material facility in Baie-Comeau, also in Quebec, is forecast to begin supplying battery makers with first-phase production in 2026.
